CMR-AC
Recent efforts have been made to create an Advisory Council with a view to promoting uniform interpretation of the provisions of the CMR Convention. The Institut du Droit International des Transports (IDIT) based in Rouen, with the support of the University of Rouen initiated this initiative. It aims to bring together academic experts on CMR to work on issues arising from its provisions and with the support of legal practitioners and industry professionals to provide opinions as authoritative solutions to these issues. On the 13th and 14th October 2022 the first face to face meeting of experts took place. It had been decided that in the first place it was necessary to consider the principles that should govern the interpretation of CMR before moving on to the examination of substantive issues. This paper was produced to provide a basis for the discussion which took place at the meeting. It sets the context to the debate about methodologies for interpretation of uniform law conventions and their possible application to CMR. At the end of the paper some conclusions and suggestions were made to aid the discussion. A link to this paper is given here:
Review of issues regarding the interpretation of CMR
A further paper was also produced to review the approach to interpretation of international conventions with particular reference to the CMR Convention. This paper is referred to in the paper immediately above. The references to the Annex Folder is a reference to a folder available currently only to members of the AC to place reviews of the approaches of the courts in their own countries. Carriage of Goods by Road and Rail
Click the link (or copy and paste) for a draft chapter on a comparative review by me of carrier liability in respect of the carriage of goods by road and rail. It is hoped that in due course a final version will be included in a research handbook which is in course of production. It is hoped that, once published, this chapter might help to stimulate more of this kind of comparative work on carriage of goods.
